Terms & Conditions

1. Introduction

Welcome to Lasting Impact.

These Terms and Conditions govern the use of our website, donations, sponsorships, partnerships, volunteer activities and contributions made to Lasting Impact (Pty) Ltd.

By using our website, making a donation, becoming a monthly supporter or participating in our initiatives, you acknowledge and agree to these Terms and Conditions.

Lasting Impact is a South African private company committed to supporting vulnerable communities through feeding programmes, schooling and education initiatives, and community outreach.

Important legal disclosure: Lasting Impact (Pty) Ltd is not currently registered as a Non-Profit Organisation (NPO) or approved Public Benefit Organisation (PBO). We do not claim tax-exempt charitable status or Section 18A approval from the South African Revenue Service (SARS).

2. Our Mission and Initiatives

Lasting Impact exists to create meaningful, sustainable change in the lives of less fortunate individuals and communities.

Our primary initiatives include:

2.1 Schooling and Education

Supporting children with school uniforms, stationery, clothing, educational essentials and other necessary schooling assistance. Our annual goal is to support at least 20 children, subject to available funding and resources.

2.2 Feeding Programmes

Supporting men’s, women’s and children’s shelters through regular food assistance, working alongside farmers, suppliers and food industry partners.

Our objective is to help provide balanced, nutritious meals, including breakfast, lunch and dinner, in accordance with appropriate nutritional guidance and available resources.

2.3 General Community Support

Providing assistance through community outreach, shelter support, essential supplies, clothing and other programmes that respond to identified community needs.

The scale, frequency and availability of these programmes depend on funding, partner participation, resources and operational circumstances.

3. Donations and Contributions

Lasting Impact accepts voluntary financial donations and contributions from individuals, businesses and organisations locally and internationally, subject to applicable laws and payment service availability.

All donations are made voluntarily and are intended to support our stated community initiatives.

By making a donation, you confirm that:

  • You are authorised to use the selected payment method.
  • The donation is made voluntarily and lawfully.
  • The information you provide is accurate.
  • You understand that a donation does not create an ownership interest, investment or entitlement to financial returns.

Donation amounts displayed on the website are in South African Rand (ZAR), unless otherwise indicated.

International donors may incur currency conversion charges or bank fees imposed by their financial institutions.

Lasting Impact reserves the right to decline or return contributions where necessary for legal, compliance, fraud prevention or operational reasons.

4. Allocation and Use of Donations

We are committed to managing donations responsibly and transparently.

Contributions may be used for:

  • Schooling and educational assistance.
  • Food procurement, meal preparation and distribution.
  • Clothing and essential supplies.
  • Community and shelter support.
  • Outreach activities and programme implementation.
  • Reasonable operational, administrative, payment processing, storage and transport costs associated with delivering our initiatives.

Where a donor contributes towards a specific programme, we will make reasonable efforts to allocate the contribution accordingly.

Should a particular project become fully funded, unavailable or impractical, we will contact the donor where reasonably possible before materially redirecting funds to a different purpose.

General, unrestricted donations may be allocated to the areas of greatest need at the discretion of Lasting Impact.

We do not guarantee that any particular donation will directly benefit a named individual unless this has been expressly agreed in writing.

5. Monthly and Recurring Donations

Supporters may elect to make monthly or recurring contributions to Lasting Impact.

By selecting a recurring donation option, you authorise the applicable payment provider to process recurring payments at the amount and frequency disclosed during registration.

Recurring donations will continue until cancelled in accordance with the payment arrangement.

Supporters may request cancellation by emailing hello@lastingimpact.co.za.

Cancellation requests should preferably be submitted at least five business days before the next scheduled debit.

We will process cancellation requests as promptly as reasonably possible. Where payment instructions have already been submitted, an additional transaction may occur, subject to the payment provider’s processing arrangements.

Cancellation stops future contributions and does not automatically entitle the donor to a refund of previous donations.

6. Corporate Partners and Sponsorships

Lasting Impact welcomes sponsorships and contributions from companies, farmers, retailers, suppliers and other organisations wishing to support our programmes.

Partnerships may include financial contributions, food supplies, educational materials, clothing, professional services, transport assistance or other resources.

Our annual partnership programmes, including Anchor Partner arrangements, may be governed by separate written agreements specifying contribution amounts, payment dates, sponsorship periods, responsibilities and termination conditions.

Any use of a partner’s name, logo, brand or promotional material must be mutually approved.

A partnership contribution does not automatically grant the sponsor management rights, commercial ownership or control over Lasting Impact’s activities.

7. Donation Confirmations and Tax Status

Where applicable, donors will receive an electronic payment confirmation or acknowledgement of their contribution.

Lasting Impact (Pty) Ltd is not currently authorised to issue Section 18A tax-deductible donation receipts.

Any receipt or payment acknowledgement issued by Lasting Impact confirms the contribution received but must not be interpreted as a SARS Section 18A tax certificate.

Donors and business sponsors are encouraged to consult their own tax advisers regarding the treatment of contributions and sponsorship payments.

8. Refunds and Cancellations

As donations are voluntary contributions intended to support community programmes, donors are encouraged to review their contributions carefully before completing payment.

Refund requests may be submitted to hello@lastingimpact.co.za within 14 calendar days of the donation date.

Each request will be assessed fairly, taking into account:

  • Duplicate or accidental payments.
  • Incorrect donation amounts.
  • Unauthorised transactions.
  • Whether the contribution has already been allocated or spent.
  • Any rights or obligations arising under applicable South African law.

Where a refund is approved, it will ordinarily be processed through the original payment method, subject to payment provider requirements.

Where funds have already been committed to or spent on the intended programme, a voluntary refund may not be possible.

Nothing in this policy excludes or limits any refund rights available under applicable law.

For partnership contributions governed by a separate written agreement, the refund and cancellation provisions of that agreement will apply, subject to applicable law.

9. Volunteering and Outreach Participation

Lasting Impact encourages individuals and businesses to participate in community outreach and volunteer initiatives.

Participation may be subject to registration, availability, safeguarding requirements and approval by Lasting Impact or the relevant shelter or facility.

Volunteers are expected to respect:

  • The dignity and privacy of beneficiaries.
  • The rules and procedures of participating shelters and homes.
  • The safety and well-being of children and vulnerable adults.
  • Instructions provided by authorised programme coordinators.
  • Restrictions on photographs, videos and social media content.

Volunteers may not photograph, record or publish identifiable information about children or other beneficiaries without the appropriate authorisation.

Lasting Impact may refuse or withdraw participation where reasonably necessary to protect programme participants or beneficiaries.

10. Privacy and Protection of Personal Information

Lasting Impact respects the privacy of donors, partners, volunteers and beneficiaries.

Personal information collected through our website may include names, email addresses, telephone numbers, payment references and information required to administer donations or programme participation.

We process personal information in accordance with applicable South African data protection legislation, including the Protection of Personal Information Act (POPIA).

  • Process and acknowledge donations.
  • Administer recurring contributions.
  • Communicate regarding programmes and partnerships.
  • Manage volunteer participation.

We do not sell donor personal information to third parties.

11. Payment Security

Lasting Impact aims to use appropriate security practices to protect donation transactions and personal information.

Payment processing is subject to the security standards and terms of the applicable payment provider.

We cannot guarantee that internet-based services will always be uninterrupted or entirely free from security risks.

Donors should never share passwords, banking PINs or one-time passwords with anyone claiming to represent Lasting Impact.

12. Transparency and Accountability

We recognise that public trust is essential to the success of our mission.

Lasting Impact aims to maintain accurate financial records and provide reasonable information regarding supported programmes and the use of contributions.

We may publish project updates, photographs, stories, campaign results and impact summaries.

Any such reporting will be subject to appropriate privacy protections and beneficiary safeguarding requirements.

Programme targets, beneficiary numbers and projected outcomes are goals rather than guarantees.

13. Website Content and Intellectual Property

All original website content, photographs, logos, designs and written materials belonging to Lasting Impact remain our intellectual property or are used with permission.

Content may not be reproduced, commercially exploited or presented as another organisation’s work without prior written authorisation, except where permitted by law.

We aim to keep website information accurate and current but reserve the right to correct errors or update information as necessary.

14. Limitation of Liability

Lasting Impact takes reasonable steps to conduct its initiatives responsibly and safely.

However, programme delivery may be affected by factors outside our reasonable control, including funding shortages, supply chain disruptions, weather conditions, shelter requirements or other unforeseen circumstances.

To the extent permitted by applicable law, Lasting Impact is not responsible for losses arising from circumstances beyond its reasonable control.

Nothing in these Terms and Conditions excludes liability that cannot lawfully be excluded or limits a person’s statutory rights.

15. Changes to Programmes and Terms

Lasting Impact reserves the right to update, modify, suspend or discontinue website features, initiatives or campaigns where reasonably necessary.

We may also amend these Terms and Conditions to reflect legal, operational or organisational changes.

Updated terms will be published on our website with a revised effective date.

Material changes affecting existing recurring commitments or partnership agreements will be communicated where required.

16. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of the competent South African courts, subject to applicable consumer protection legislation and other mandatory legal requirements.
